U.S. Supreme Court Blocks Federal Vaccine Requirement for Large Employers

On Jan. 13, the U.S. Supreme Court blocked the federal emergency rule issued by OSHA that would have required large employers to ensure their employees are either vaccinated against COVID-19 or test weekly. The Supreme Court allowed the vaccine mandate for certain healthcare workers to stand.

Regarding the vaccine mandate for federal contractors, in December 2021, a lower court granted a nationwide injunction prohibiting the federal government from enforcing the mandate. That decision may still make its way to the Supreme Court as well, but some legal experts predict the Supreme Court’s decision on the large employer mandate may foreshadow a future ruling blocking the federal contractor mandate.
