As we prepare for 2024, one area of compliance often overlooked is labor law posters. Typically, the new year brings many legislative changes (minimum wage, paid leave, etc.) that employers are required to communicate to their workforce.

Every business in the U.S. with one or more paid employees is required to have pertinent federal, state, city and county labor law postings displayed in their office in an unblocked, unlocked public area for both applicants and employees to see. A Labor Law Poster combines all mandatory postings onto one convenient, laminated, space-saving sheet. Businesses with multiple locations must display these postings in each location.

Federal Postings (applicable in all 50 states with one exception — a small handful of states have state-specific OSHA notices that supersede the Federal OSHA notice and are displayed instead):

  • Federal Minimum Wage (FLSA)
  • Occupational Safety & Health Act (OSHA)
  • EEO Know Your Rights
  • Family and Medical Leave Act (FMLA)
  • Employee Polygraph Protection Act (EPPA)
  • Uniformed Services Employment & Reemployment Act (USERRA)

Examples of State Postings (varies greatly state by state):

  • State Minimum Wage
  • Unemployment and Disability Insurance
  • Family Leave Insurance
  • Workers’ Compensation
  • Payment of Wages
  • Child Labor Law, etc.

OneDigital has partnered with PosterElite to provide clients with an up-to-date, All-in-One State & Federal Labor Law Poster that includes a comprehensive, pay-as-you-go e-update for physical worksites to ensure year-round posting compliance.

What About Remote Workers?

As of December 2020, employers nationwide are legally obligated to provide electronic labor law posters to their entire workforce, and this includes those working in a remote or hybrid capacity. The DOL and OSHA recommend a formal acknowledgment from the employee and urge the employer to make it as easy as possible for the employee.

As part of PosterElite's E-Update Service, employers receive free access to the ePosterService for Remote/NYS Employees. This solution provides online access to the labor law postings for remote or NYS employees, along with a certificate of acknowledgment tracking feature and all city, county, state & federal updates.

What About Local City & County Notices?

The physical, laminated labor law poster includes State & Federal labor law postings but not local city or county notices. Not all cities or counties have local required notices, but if they do, they are available as free downloads in the supplemental posting library provided by PosterElite.

Why Engage with a Poster Update Service?

While having a physical labor law poster is great, buying a new one each time a labor law posting changes is not. The average state is experiencing 2-3 changes annually, and some states anticipate as many as 6-8 changes in the coming years. This does not count local city & county notices. On average, there are 100-150 labor law posting updates every year. Employers are required by law to be vigilant and aware of these changes. This is a time-consuming and complicated task that most businesses do not have the time, patience, resources, or know-how to accomplish.

The E-update Service ensures that you are always in compliance by constantly monitoring all county, city, state, and federal-mandated labor law postings and automatically providing you with newly updated postings whenever laws change. The pay-as-you-go E-Update Service takes the worry, uncertainty, and hassle out of Labor Law Posting Compliance.

Penalties and Fines for Noncompliance

Failure to post required federal employment law notices can exceed $34,000 in fines. State fines and penalties will vary by agency and are also determined case-by-case.

Is your business compliant regardless of where your employees are working? Our partner, PosterElite, has solutions that will help meet your needs.
