Fight the Fraud Legislation Becomes Law in Kansas

The Kansas Credit Union Association advocacy team recently attended the ceremonial signing of HB 2591 in Gov. Laura Kelly's office, celebrating the enactment of legislation that strengthens fraud prevention efforts across Kansas. The bill marks the culmination of the association's yearlong Fight the Fraud campaign, a public awareness and legislative initiative focused on educating Kansans about common scams and equipping credit unions with additional tools to help protect members from financial fraud.

HB 2591 authorizes credit unions to establish trusted contact programs, allowing members to voluntarily designate a trusted family member or friend who may be contacted if the credit union reasonably believes the member is the target of financial exploitation or a scam. By involving a trusted contact early, credit unions may be able to intervene before a fraudulent transaction is completed, helping members avoid significant financial losses.

The legislation also establishes new safeguards for cryptocurrency kiosks, which have become an increasingly common tool used by fraudsters. Criminals frequently direct victims to deposit money into cryptocurrency kiosks as part of government impersonation scams, romance scams, investment schemes, and other forms of financial fraud.

An investigation by the Iowa Attorney General's Office found that more than 98% of transactions processed through these kiosks were fraudulent. Under HB 2591, kiosk operators must register as money transmitters, display clear fraud warning notices, and implement a holding period during which eligible customers may be able to recover their funds before transactions become final.

In June, the association expanded its Fight the Fraud campaign with a digital advertising initiative thanking legislators who supported HB 2591. The campaign generated positive feedback, and several lawmakers reached out to express their appreciation for the recognition and the collaborative effort to protect Kansas consumers.

The passage of HB 2591 reflects the successful partnership among credit unions, lawmakers, and consumer advocates to address emerging fraud threats while providing financial institutions with practical tools to better protect the communities they serve.
