A bankruptcy filing by a member can turn collection policies upside-down and severely impact a credit union’s rights. Protect the interests of your credit union by knowing how bankruptcy works as well as what steps you must take and what steps you cannot take when your member files for bankruptcy. The instructors will provide real-world insights on what actions credit unions can take in a bankruptcy case and whether an attorney will be needed to complete that action.

This seminar is designed to provide you with information and basic skills to help you:

  • Analyze and understand Chapter 7 and Chapter 13 bankruptcy filings.
  • Comply with bankruptcy law requirements.
  • Proactively protect your credit union's interests.

Attendees will learn the mechanics of bankruptcy and specific time-tested techniques that are effective solutions for credit unions. This introductory program will be valuable for anyone seeking a review of the frontline issues that credit unions face when a bankruptcy is filed. Attendees will have a better understanding of how to both prevent the credit union from getting sued and collect the money that it is owed.

Tom Sharp

Tom Sharp has been with the Blalack & Williams team for more than 20 years, representing credit unions in federal, state, and bankruptcy courts across Texas. Sharp has handled more than 10,000 bankruptcy cases for credit unions and has appeared in person in all four Texas districts. He conducts seminars on bankruptcy and collection matters regularly.

Sharon Sjostrom

Sharon Sjostrom is a partner with the law firm of Blalack & Williams. In addition to assisting credit union clients with advice and counsel on an individual basis, Sjostrom presents seminars and provides in-house training for credit union employees. She has vast real-world knowledge and extensive experience on a variety of credit union issues, including bankruptcy, foreclosures, litigation, operations, vendor contract reviews, regulatory and compliance matters, and personnel issues.

Whether your credit union repossesses one vehicle a month or 30 vehicles a month, you are vulnerable to a wrongful repossession lawsuit if you do not handle your repossessions in compliance with all applicable laws. Most importantly, and unfortunately, when a credit union is being sued, it’s too late to do anything about your repossession procedures and notices.

In this informative session, credit union attorneys Mike Blalack and Rob Woodcock will show attendees exactly how a consumer lawyer representing your member will question you, the claims they will make, and the documentation they will require from you. Blalack and Woodcock will address the key legal issues your member’s lawyer will likely focus on to attack the legality of your repossessions, your internal repossession procedures, and the disposition of your collateral.

All collectors, as well as all credit union management officials, will benefit from this legal checkup and learn how to recognize any existing operational and compliance errors and correct them with proper repossession forms and repossession procedures before the credit union gets sued. Attendees will also learn how to analyze and understand Chapter 7 and Chapter 13 bankruptcy filings.

Mike Blalack is an attorney from Dallas, with the law firm of Blalack and Williams, P.C., who has represented credit unions for more than 40 years. Blalack provides collections, regulatory, and compliance training in-house and at conferences throughout Texas for the Cornerstone Credit Union League, where he is consistently one of the highest-rated speakers.

Rob Woodcock

Rob Woodcock is a credit union attorney who has been practicing with the law firm of Blalack & Williams, P.C., for more than 15 years. Woodcock is part of the litigation group and focuses on collections and creditors rights.

All cancellations must be received in writing. Please provide a brief explanation for the cancellation and submit it via email to training@cornerstoneleague.coop. Cancellations received more than 30 days before the event are subject to a 25% administrative fee on the order total. No refunds will be granted for cancellations received on or after 30 days before the event. Substitutions are accepted before the start of the program. Additional costs may apply. Please provide the event name, current participant name, and new participant name to training@cornerstoneleague.coop.

Cornerstone League reserves the right to cancel or reschedule the event due to unforeseen circumstances. If the event is rescheduled to another date or modified (virtual or hybrid), your registration will automatically transfer. If the event is rescheduled or location is changed, and you are unable to attend, your fees will be refunded.
