CUNA, Ohio League to Meet with DOJ on ADA Issues

Credit Union National Association advocacy staff and Ohio Credit Union League staff and member credit unions will meet with Department of Justice officials Tuesday as CUNA continues its push for clarity surrounding the Americans with Disabilities Act’s application to websites. Credit unions are facing increasing legal threats due to confusion over how the ADA applies to websites, and CUNA has made it a top priority to find a solution.

Credit unions saw a positive step forward Friday, as a federal district court in Virginia threw out a lawsuit brought against a credit union. The court dismissed the suit because the plaintiff was unable to show harm since they could not participate in any of the Northwest Federal Credit Union's services since they were not eligible for membership, and because the court held that a website is not a public accommodation.

“We’re planning to discuss Friday night’s specific credit union ruling in the fourth circuit, in conjunction with other litigation of this issue,” said Leah Dempsey, CUNA senior director of advocacy and counsel. “We will continue to urge the DOJ to provide formal or informal guidance going forward so that credit unions can have certainty about requirements.”
