The aircraft lien statute allows liens in favor of anyone who stores, fuels, repairs, or does maintenance on aircraft, but the current statute lacks clarity about the validity of the lien if the owner of the plane is absent and doesn’t give consent.
HB 4262 by Rep. Drew Darby (R-San Angelo) amends the statute to clarify that providing fuel presumes parties exercising a certain level of control over an aircraft, such as pilots, are authorized to incur charges that give rise to the lien.
The bill passed on a unanimous vote and moves to the Senate.
