Question: Our member brought in a check from 2017 and wants to file a claim that the check was forged. How long do they have to make the claim?
Answer: It’s dependent on state law.
In the three Cornerstone states, a claim for a breach of warranty must be brought within three years per UCC. Other states may have longer periods of time. Either way, a check from 2017 will have likely passed the period by which a claim can be made and could be denied.
