Texas Senate to Consider House Amendments on Bill Prohibiting Surcharges on Debit Cards

The Texas Senate will consider the House amendments on a bill that would prohibit a surcharge on the use of debit cards or stored value cards and adds a $1000 fine for each violation. SB 641 by Sen. Charles Schwertner (R-Georgetown) defines "surcharge" as a fee charged to a person using a debit or stored value card that would not be imposed on a customer paying by other means.

The bill adds a civil penalty to be enforced by the attorney general or county prosecuting attorney for violating the current law prohibiting surcharges on debit card purchases. The House amendments reduced the fine to $500 and added a provision to allow a merchant to correct the infraction once before civil penalties are administered.
