Texas Senate Passes HB 2394 to Protect Financial Institutions from Being Compelled to Produce Records Without Payment

HB 2394 by Rep. Drew Darby (R-San Angelo) has been passed by the Senate on a vote of 31 to 0. 

The bill amends the Finance Code to protect financial institutions from having to produce customer records during the discovery process if the requesting party has not paid for them, nor can it be penalized for failure to do so. The bill provides that a court may not order the financial institution to produce the record, nor can the financial institution be held in contempt of court for failing to produce the record. 

HB 2394 now goes to the governor.
