Texas House Passes Bill to Give Mortgage Loan Information to Surviving Spouses, Senate Committee Votes HB 831 Out Favorably

HB 831 by Rep. Helen Giddings (D-DeSoto) passed the Texas House by a vote of 141 to 2, and has been voted favorably from the Senate Business and Commerce Committee. Sen. Royce West (D-Dallas) is the Senate sponsor.

The bill requires mortgage servicers, lending under Chapter 343 of the Finance Code, to disclose home mortgage information to a surviving spouse of the borrower when presented a copy of the death certificate and an affidavit that they are the spouse of the deceased borrower and living in the mortgaged property. Credit unions are exempt from Chapter 343 of the Finance Code.
