Texas House Committee Hears Vehicle Storage Facility Notice Bill

The Texas House Licensing and Administrative Procedures Committee heard HB 1247 by Rep. Joe Pickett (D-El Paso), a bill designed to update the statutes governing notice by vehicle storage facilities (VSF) on vehicles titled out of state.

The bill would allow VSFs to electronically access information on vehicle registration and lienholder information using a vehicle identification number (VIN) inquiry and a secure portal, which the proponents of the bill say will result in more accurate and faster notice to owners and lienholders. Currently, the necessary information is gathered from other states manually. According to the bill author, 80 percent of written requests to other states for title information do not get a response.

This bill changes the way information for notice is gathered but does not change the notice process.

Testimony in support of the bill focused on the difficult and often unsuccessful process of giving proper notice without access to electronic records. The bill was left pending.
