Texas House Committee Hears Bill Allowing Transfer on Death for Vehicles

The House Judiciary and Civil Jurisprudence Committee heard HB 1753 by Rep. Jessica Farrar (D-Houston). The bill would permit an owner or owners of a vehicle to transfer title to a sole beneficiary upon the death of the owner(s), allowing heirs to avoid the costly probate process. This transfer-on-death process is similar to the payable-on-death feature on financial accounts.

A beneficiary would be designated by the owner submitting an application for title with the designation. A designated beneficiary would be responsible for all liens, and the lienholder would retain all rights under the law.

Farrar offered a committee substitute that clarified the definition of "motor vehicle." The bill was left pending.
