Texas Credit Union Department Proposed Rules for Comment

The Texas Credit Union Commission voted at its Nov. 3 meeting to publish the following proposed rules for comment in the Texas Register. Comments or suggested changes to the rules should be submitted in writing within 30 days of the publication date, Nov. 17, 2017, by mail to the Credit Union Department, or by email to cudmail@cud.texas.gov. The comment period ends Dec. 17, 2017.

  • 7 TAC Section 91.4001 imposes a new requirement that credit unions using electronic means or facilities employ a tested incident response to minimize the impact of a data breach or other electronic incident on members, expands the examples of electronic means or facilities to include mobile applications, and eliminates the reference to the World Wide Web;
  • 7 TAC Section 91.4002 requires a credit union to review the adequacy of its website’s security measures annually instead of once every two years and updates the rule for clarification and better readability;
  • 7 TAC Section 91.5001 encourages credit unions to post notice of the emergency closing of an office or operation on its website and social media pages;
  • 7 TAC Section 91.5005 requires credit unions to post notice of a permanent closing of an office on its website and social media pages at least 30 days prior to the closing; and
  • 7 TAC Section 91.1010 provides guidance to credit unions when they are considering a voluntary liquidation of a solvent institution.
