FCC Opens CUNA’s TCPA Petition for Public Comment

The Federal Communications Commission granted CUNA’s request and put out its Telephone Consumer Protection Act (TCPA) petition for public comment. CUNA filed its petition last week, outlining two ways credit unions could achieve clarity regarding member communications under the TCPA.

“We thank the FCC for responding quickly to our concerns about credit union-member communication,” said CUNA President/CEO Jim Nussle. “During the comment period, we will be working hard to educate stakeholders about the TCPA and what we’re seeking, and we hope that credit unions will make their voices heard as the FCC considers the next steps.”

Comments on the petition are due Nov. 6.

CUNA will conduct a webinar Wednesday at 2 p.m. (CT) to review the regulatory relief goals of the petition, and explain the comment submission process, which is different than normal comment periods. The webinar is free to CUNA members, and registration is open now.

Cornerstone will be commenting on the petition on behalf of credit unions in Arkansas, Oklahoma, and Texas. All area credit unions are strongly urged to attend the Wednesday seminar and submit a comment letter as well.

CUNA’s requested the FCC issue a declaratory ruling that the following be exempt from the TCPA’s prior express consent requirement:

  • Wireless informational calls to credit union member-owners with whom the credit union has an established business relationship; or
  • Where the call or text is in fact free to the receiving party.
