CUs Could Find Themselves on the Wrong End of a Lawsuit by Failing to Comply with EEOC Requirements

For the fifth consecutive year, allegations of retaliation is reportedly the most frequently cited basis for charges of discrimination, both as a matter of number of charges (38,539) and as a percentage of all charges (41.1 percent). According to the U.S. Equal Employment Opportunity Commission (EEOC), both the number of charges and percentages increased from 2012 to 2013. Because retaliation claims are becoming more and more common, Credit Union Resources HR Consultant Kimberly Jones says it’s critical that credit unions stay in compliance with EEOC requirements.

“Having effective policies, procedures and programs in place will help credit unions avoid finding themselves on the wrong end of a lawsuit in retaliation claims, and they will also help reduce a credit union’s exposure to other employment-related claims,” notes Jones.

According to Jones, employment laws can be difficult to understand or interpret, and that is why many companies choose to outsource the HR function.

“Some organizations choose to outsource only pieces of the HR function, like payroll or recruiting, while others outsource their entire HR department,” says Jones.

Other EEOC statistics:

  • The second most frequently cited bases for charges of discrimination was race discrimination, which was cited in 33,068 charges, representing 35.3 percent of all charges.
  • The next most frequently cited basis was sex discrimination, including sexual harassment and pregnancy discrimination, which was cited in 27,687 charges (29.5 percent of all charges.), followed by discrimination based on disability, which was cited in 25,957 charges (27.7 percent).
  • The state of Texas had a total of 9.7 percent of all the U.S. charges files (highest among any state) at 9,068.
  • Retaliation charges filed in 2013 were 2,816 which were 42.1 percent of all charges files in Texas.
