Cornerstone Update on ADA Litigation; Accessibility Statement
Tuesday, February 13, 2018 7:00 AM

In the Compliance section of Cornerstone's website is a new sample ADA accessibility statement that credit unions can use on their websites. View the sample statement here. Your user ID and password will be required for access.

During yesterday's ADA audio conference update with member credit unions, Cornerstone SVP Regulatory Compliance Counsel Suzanne Yashewski discussed the status of ADA website litigation, including Cornerstone's intention to co-write an amicus brief with CUNA and potential financial support for credit unions affected by ADA litigation. Cornerstone President/CEO Caroline Willard has directed staff to evaluate credit union candidates to determine if one or more may be a good test case to push through a lawsuit in various districts in hopes of obtaining multiple favorable rulings. Our best candidates will likely be small credit unions with a limited field of membership.

Cornerstone is also determining options for establishing an ADA defense fund wherein credit unions could contribute funds to assist the chosen credit union(s) in defending the case, and Cornerstone would match those funds up to a predetermined limit.

If your credit union has been sued regarding the ADA website compliance issue and you are considering fighting rather than settling, please contact Suzanne Yashewski at to determine if Cornerstone may be able to provide financial assistance.
