Comments on TCPA Petition, Financial Records Access Due in February

Two proposals have comment deadlines in February: a petition seeking Telephone Consumer Protection Act (TCPA) clarifications and one on consumer access to financial records. Information on those and future comment deadlines can be found on CUNA’s Regulatory Advocacy page.

Comments are due Feb. 1 on a petition seeking clarifications on the TCPA exemption for calls collecting debt owed to or guaranteed by the federal government. CUNA has expressed a number of concerns with a July 2015 TCPA ruling by the Federal Communications Commission, believing it goes far beyond the act’s scope and purpose. The Budget Act of 2015 amended the TCPA to create exemptions for calls made to cell phones when collecting debt owed to the federal government.

Also due in February are comments on a Consumer Financial Protection Bureau request for feedback on consumers' ability to access financial account and account-related data in electronic form, as provided for by the Dodd-Frank Act.

The CFPB is seeking comments about consumer access to such information, including access by entities acting with consumer permission, in connection with the provision of products or services that make use of that information.

Input on this proposal can be sent to CUNA by Feb. 1, or as soon as possible, and is due to the CFPB by Feb. 21.
